1. Overview
1800restoreit.com ("Site") is owned and operated by Talos LLC ("Company," "we," "us," or "our"). 1800 Restore is a lead generation marketplace that connects homeowners and property managers ("Users") with independent, vetted restoration contractors ("Contractors") for water damage, fire damage, and mold remediation services. We do not perform restoration work ourselves.
2. Acceptance of Terms
By accessing or using this Site, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Site.
3. Services Provided
1800 Restore operates as a marketplace and referral platform. We collect information about your restoration needs and match you with qualified contractors in your area. We are not a restoration company and do not guarantee the quality, timeliness, or outcome of any work performed by contractors.
4. User Responsibilities
You agree to provide accurate and truthful information when submitting a request through our platform. You understand that submitting a request may result in being contacted by one or more contractors via phone, email, or text message regarding your restoration needs.
5. Contractor Relationships
Contractors on our platform are independent businesses, not employees or agents of Talos LLC. We vet contractors for licensing and qualifications, but we are not responsible for any disputes, damages, or issues that arise between you and a contractor. Any agreements, contracts, or transactions are between you and the contractor directly.
6. Contractor Terms & Billing
Contractors who sign up on our platform agree to receive lead referrals. The first 3 leads are provided at no cost. After the free trial period, contractors will be charged a per-lead fee based on job characteristics. By signing up and providing a payment method, contractors authorize Talos LLC to charge the payment method on file for leads delivered after the free trial.
Billing Disputes: If you believe you have been charged in error, contact us at help@1800restore.com. We will make reasonable efforts to investigate and remedy legitimate billing errors. However, we make no guarantees, warranties, or promises regarding the outcome of any dispute. Our obligation is limited to good-faith review. We are not liable for duplicate charges, failed charges, bank fees, overdrafts, or any consequences of payment processing. Disputes may also be raised with your card issuer. We reserve the right to suspend or terminate accounts with unresolved billing disputes.
7. Disclaimer of Warranties
THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TALOS LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR QUALITY OF ANY CONTENT, LEADS, OR CONTRACTOR SERVICES. YOU USE THE SITE AND SERVICES ENTIRELY AT YOUR OWN RISK.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TALOS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES—including but not limited to loss of profits, revenue, data, goodwill, or business opportunity—arising from or related to your use of the Site or services, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). This limitation applies even if we have been advised of the possibility of such damages. We are not liable for any damages arising from contractor work, delays, disputes, lead quality, failed matches, billing errors, payment processor failures, or third-party conduct.
9. Indemnification
You agree to indemnify, defend, and hold harmless Talos LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site or services; (b) your violation of these Terms; (c) your violation of any third-party right; (d) any dispute between you and a contractor; or (e) any content or information you submit through the Site.
10. No Guarantee of Service
We do not guarantee that you will be matched with a contractor, that a contractor will be available in your area, that any restoration work will meet your expectations, or that leads will result in closed business. Matching depends on contractor availability, service areas, and other factors outside our control. We are not responsible for contractor responsiveness, quality of work, or any outcomes.
11. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, government actions, strikes, power outages, internet failures, or payment processor outages.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Modifications
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated date. Continued use of the Site after changes constitutes acceptance.
14. Governing Law
These terms are governed by the laws of the State of Maryland. Any disputes shall be resolved in the courts of the State of Maryland.

- Photos: images you upload to document damage.
2. How We Use Your Information
We use your information to:
- Match you with qualified restoration contractors in your area.
- Send your information to matched contractors so they can contact you about your restoration needs.
- Send you confirmation emails regarding your submitted request.
- Process contractor payments and manage contractor accounts.
- Improve our platform, services, and user experience.
- Run advertising campaigns and measure their effectiveness.
3. Information Sharing
We share your contact and property information with contractors matched to your request. This is the core function of our service. We do not sell your information to third parties for marketing purposes unrelated to your restoration request. We may share information with service providers who help us operate the platform (email delivery, payment processing, analytics).
4. Payment Information
Contractor payment information is collected and processed through Stripe, a PCI-compliant payment processor. We do not store credit card numbers on our servers. Payment data is handled entirely by Stripe in accordance with their security standards.
5. Cookies and Tracking
We use cookies and similar technologies, including Google Analytics and Google Ads tracking, to understand how visitors use our site and to measure advertising performance. You can control cookie preferences through your browser settings.
6. Data Retention
We retain your information for as long as necessary to provide our services and comply with legal obligations. Lead data is retained to support contractor relationships and for internal record-keeping. You may request deletion of your data by contacting us at help@1800restore.com.
7. Data Security
We take reasonable measures to protect your information, including encrypted connections (HTTPS), secure server infrastructure, and access controls. However, no method of transmission over the internet is 100% secure. We make no guarantees, warranties, or representations regarding the security of your data.
